Another challenge to the Pledge of Allegiance is underway in Massachusetts state court -- but this one is a bit different. The lead attorney says it's not about the 1st Amendment; it's confined solely to a state law.
"The state constitution's Equal Rights Amendment, which expressly forbids discrimination based on religion or creed."
Niose says there's no federal component to this challenge.
But South Texas College of Law Professor Gerald Treece says he expects it to reach the U.S. Supreme Court some day.
"We'll be lucky to get a decision out of the Massachusetts courts this year or even early next year.
Professor Treece says it'll take years to reach the U.S. Supreme Court, if it does.
